Terms.

These terms apply to every use of this website and every service offered through it by Oliver Higgins, operating as higgi, Amsterdam. By using the site, the free scan, or a demo, you agree to them. A separate written agreement for paid work takes precedence over these terms where the two differ.

The scan and any demo are offered free and without obligation, as an illustration of what could be built. They are provided as-is, with no guarantee of a specific outcome, ranking, conversion, or revenue. Benchmark figures shown on the site are third-party industry references, not a promise about your result. Nothing in a free scan or demo creates an obligation on either side to enter a paid engagement.

A quote is valid for thirty days unless stated otherwise and is not binding until confirmed in writing by both sides. Paid work is governed by the written agreement for that engagement: its scope, price, timeline, and payment terms. Where that agreement is silent, these terms fill the gap.

higgi delivers the agreed work with reasonable skill and care, and on the ownership principle stated on the site: the code, content, data, and any agents built for you stay yours. In return you provide, on time, the access, content, and feedback the work needs, and you pay the agreed amounts by the agreed dates. Late payment may pause work after notice.

On full payment, the deliverables built specifically for you are yours to keep, use, and hand on. Pre-existing tools, libraries, and general know-how that higgi reuses across clients remain higgi's, licensed to you for the deliverable. You are responsible for holding the rights to any content, logos, or data you supply.

higgi is liable only for direct damage caused by an attributable failure, capped at the amount paid for the engagement in question (or, for free services, capped at zero, as nothing was charged). higgi is not liable for indirect or consequential loss such as lost revenue, lost data beyond the most recent backup, or third-party outages. Nothing here limits liability that cannot be limited by law, such as for intent or gross negligence.

A free scan or demo can be walked away from at any time by either side, with no cost. For paid work, cancellation follows the written agreement; work already done and approved is invoiced up to the cancellation date.

Dutch law applies. Disputes go to the competent court in the district of higgi's place of business, unless mandatory law points elsewhere. Questions first, though, to oliver@higgihq.com, most things are settled with a conversation.
